Welcome to Creative Assist AI. By using our website, platform, or services, you agree to be bound by the following Terms and Conditions. Please review them carefully. If you do not agree, do not use our services.

1. Use of Services

You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

  • submit or share content that is illegal, harmful, or infringes third-party rights (including IP and privacy);

  • attempt to hack, disrupt, scan, or gain unauthorised access to our systems or other users’ data;

  • misuse sharing, referral, or promotional tools in a way that could harm users or the platform.

We may suspend or terminate accounts that breach this section.

2. Account Registration

Certain features require registration. You are responsible for:

  • providing accurate, current, and complete information during sign-up and keeping it updated;

  • maintaining the confidentiality of your credentials;

  • all actions taken through your account.

We may suspend or delete accounts that are fraudulent or violate these Terms.

3. Intellectual Property

All platform software, tools, features, designs, logos, text, graphics, and other materials are owned by or licensed to Creative Assist AI and protected by law. You may not copy, modify, distribute, or create derivative works without our prior written consent, except where permitted by mandatory law.

4. User Content and Sharing

Our platform may allow you to input, generate, store, or share content (“User Content”). You:

  • warrant that your User Content complies with law and does not infringe third-party rights;

  • grant Creative Assist AI a non-exclusive, worldwide, royalty-free licence to host, store, back up, display, and use your User Content as necessary to operate, secure, and improve the Services and (with your opt-in where required) for marketing/showcase purposes.

We are not responsible for User Content. If you believe content infringes rights, contact us (see §13).

5. Fees and Payment

  • Prices are listed in EUR and are payable in advance unless otherwise agreed in writing. Applicable taxes may be shown at checkout.

  • Payments are processed by trusted payment providers; full card details are not stored on our servers.

  • Failure to pay may lead to suspension or restricted access.

6. Cancellations and Refunds

  • Purchases are non-refundable, except where required by applicable law or where (i) the service was not delivered, (ii) a verified technical defect prevented access/use, or (iii) a duplicate charge occurred.

  • For EU digital content delivered immediately at your request, the statutory 14-day withdrawal right does not apply once performance starts (Czech Civil Code § 1837(l)).

  • Refund requests must be submitted within 14 days of purchase with relevant evidence. Approved refunds are returned to the original payment method within a reasonable period.

7. Disclaimers and Liability

The Services and all outputs are provided “as is” and “as available” to the extent permitted by law. We disclaim all implied warranties (merchantability, fitness for a particular purpose, non-infringement).
To the maximum extent permitted by law, our aggregate liability for direct losses is limited to the total fees you paid to us for the Services in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages (including lost profits, data, or goodwill). Nothing limits liability that cannot legally be limited.

8. Third-Party Links and Services

The platform may contain links to third-party websites or integrate external services. We do not control and are not responsible for their content or privacy practices. Use of third-party services is at your own risk.

9. Suspension and Termination

We may suspend or terminate your account or access to the Services at any time if you breach these Terms, pose security or legal risk, or misuse the platform. You may stop using the Services at any time.

10. Changes to These Terms

We may update these Terms to reflect operational, legal, or technical changes. We will post the updated Terms with a new effective date. Continued use of the Services after the update constitutes acceptance of the revised Terms.

11. Governing Law and Disputes

These Terms are governed by the laws of the Czech Republic. Courts of the Czech Republic (with local jurisdiction as provided by Czech procedural rules) have exclusive jurisdiction over disputes. If you are an EU consumer, you may also bring proceedings in your country of residence and may use the EU Online Dispute Resolution platform.

12. Age Requirement

The Services are intended for adults. By using the website, you confirm you are at least 18 years old (or have valid, verifiable consent of a parent/guardian where local law allows). If you are under the applicable age, do not use the Services.
